The Third Circuit struck the rifle and magazine bans. The State says the decision is effective July 31 — we open NJ ordering the moment it is.
Colorado
● Deadline Aug 1
SB25-003 takes effect August 1. Transfers on covered semiautos must be fully complete before then — the realistic window is this week.
Virginia
Statewide injunction — sales resumedThis spring, Virginia's General Assembly passed and Governor Spanberger signed Senate Bill 749, which would have prohibited the sale, purchase, import, manufacture, and transfer of a broad category of "assault firearms" along with magazines holding more than 15 rounds, beginning July 1, 2026. Firearms and magazines already owned by Virginians were never affected.
The law never got a full month of enforcement. In Santolla v. Katz, Judge Jeffrey L. Campbell of the Washington County Circuit Court entered a preliminary injunction on June 29, then issued a letter opinion on July 7 clarifying that the injunction binds every law-enforcement agency and every Commonwealth's Attorney in Virginia — not just the parties in his courtroom. The court found the ban likely conflicts with Article I, Section 13 of the Virginia Constitution, and set the statewide injunction to take effect July 21, 2026, giving agencies time to be notified. The injunction runs for one year while the case is litigated, and a companion restriction on carrying these firearms in public was separately pushed back to July 2027 by budget language.
What this means for your order
As of July 21, we have resumed processing and shipping previously restricted products to Virginia — including MAX-series and DY12 semiautomatic shotguns and magazines over 15 rounds. The rest of the line never stopped. All orders transfer through your Virginia FFL with a standard background check, exactly as before.
One honest caveat: the Attorney General has said the Commonwealth will appeal, and this fight is widely expected to reach the Supreme Court of Virginia, with a parallel federal challenge also pending. The window is open today. If a covered item has been on your list, we would not assume the window stays open forever.
New Jersey
Rifle + magazine bans struck — effective July 31On July 17, 2026, the full U.S. Court of Appeals for the Third Circuit, sitting en banc, ruled 10–5 in Association of New Jersey Rifle and Pistol Clubs v. Attorney General of New Jersey that New Jersey's ban on semiautomatic rifles and its 10-round magazine limit both violate the Second Amendment. It is the first time a federal appeals court sitting en banc has struck down a state ban of this kind, and it creates a direct circuit split — the Seventh Circuit went the other way just eight days earlier — with the Supreme Court already set to hear the AR-platform question this fall.
The operative question for buyers is when. The New Jersey State Police and the Attorney General's office have both stated that the decision is effective July 31, 2026, and that official guidance for residents and dealers is being prepared. We are watching for that guidance daily.
What this means for your order
Barring a stay, on July 31 we expect to open New Jersey ordering for the items the court's ruling covers: TM22 rifle configurations previously restricted under the rifle ban, and DY9 / DY9Z magazines over 10 rounds. Two important limits: the en banc court sent the remaining portions of New Jersey's "assault firearm" definition back to the lower court, so the semiautomatic shotgun provisions remain in force — MAX-series and DY12 shotguns are still restricted for NJ until that changes. And every existing state requirement still applies: FID card, pistol purchase permits, and transfer through a New Jersey-licensed dealer.
We know some of you will try to order on July 26 and hit a wall. Please hold until the effective date — shipping restricted items into New Jersey a day early helps no one, least of all you. The moment the decision is effective and shipment is lawful, the gate opens.
Colorado
SB25-003 permit regime begins August 1Colorado's SB25-003, signed in April 2025, takes effect August 1, 2026. From that date, buying, selling, or transferring a "specified semiautomatic firearm" (SSF) in Colorado requires the buyer to first complete a state-verified safety course and obtain a sheriff-issued eligibility card. An SSF is defined as a semiautomatic rifle or semiautomatic shotgun with a detachable magazine, or a gas-operated semiautomatic handgun with a detachable magazine. Excluded from the definition: manually operated firearms (bolt, pump, lever, slide), rimfire firearms .22 caliber or smaller unless the firearm uses a separate upper and lower receiver, semiautos with permanently fixed magazines of 15 rounds or fewer, and recoil-operated handguns. To be clear about what the law is not: it is not a possession ban, there is no registration, and everything you already own is unaffected.
After August 1, the purchase path for a covered firearm is: pass a sheriff background review and pay the processing fee for an eligibility card, then complete a Colorado Parks and Wildlife verified safety course (a 4-hour basic or 12-hour extended course, plus a $52 state course-record fee). Colorado's existing 15-round magazine limit and three-day waiting period remain in place — the magazine violation penalty actually increases under the new law. A federal challenge, Del Toro v. Polis, is pending, but no injunction has issued, so August 1 is real.
Where every Derya platform lands under SB25-003
TM22 rifles — exempt. Every TM22 is a .22 LR rimfire built on a single receiver across all models — and the law's rimfire exclusion only fails when a firearm uses a separate upper and lower. That keeps the entire TM22 line outside the SSF definition. After August 1, the TM22 remains one of the few AR-style rifles a Colorado buyer can purchase with a standard transfer — no eligibility card, no course. The state's draft guidance has swept in some split-receiver .22 platforms from other makers; the TM22's one-piece receiver is exactly what the statutory exemption protects, and we are monitoring the final guidance to confirm it lands where the statute puts it.
DY9 / DY9Z pistols — exempt. These are recoil-operated, locked-breech handguns, not gas-operated. They are outside the SSF definition and purchase normally after August 1, shipped with Colorado-compliant 15-round magazines.
RAN / RANX lever-actions — exempt. Manually operated firearms are excluded outright. The lever gun does not care what year it is.
MAX-series + DY12 shotguns — covered. Semiautomatic, detachable magazine: squarely inside the SSF definition. After August 1, Colorado buyers will need a valid eligibility card.
The deadline math — read this before ordering
This section applies to the MAX-series and DY12 only — the rest of the line is unaffected. The transfer must be fully complete — Form 4473, background check, and Colorado's three-day waiting period — before August 1. Working backward, your dealer needs to start your 4473 by Tuesday, July 28. A new online order placed today, even shipped overnight from our Jacksonville facility, arrives with essentially zero margin. Our honest recommendation: if you want a MAX or DY12 under the current rules, buy from your Colorado dealer's in-stock inventory this weekend and get your paperwork started immediately. We are prioritizing every open Colorado order for overnight dispatch through Monday, July 27, but we cannot guarantee any order placed now will complete transfer in time. After August 1, we keep shipping to Colorado dealers as always — the change is on the buyer's side of the counter, and we'll verify eligibility-card requirements with our dealer network so transfers stay clean.
